Assalaamu'alaykum wa rahmatullah wa barakaatu,

May the peace of Allah and His blessings be upon you.

I pray that all of you are well, by His grace.

Attached is a research paper authored by Shaikh Mokhtar Maghraoui on the permissibility of using astronomical calculation to determine the month of Ramadan. Attached, as well, is a summary of the main arguments in the research paper.

The recent 2006 decision by the Fiqh Council of North America on this matter has raised many concerns. The paper addresses those concerns. Shaikh Mokhtar was part of the Fiqh Council for about 5 years. He left last year.

Shaikh Mokhtar, as you might know, is a much respected and loved scholar in North America. He is thoroughly versed in the Islamic sciences. And his doctorate joined between the fields of physics and engineering.

This paper is an important contribution to the issue of astronomical calculation and moonsighting. The analysis is scholarly, balanced and compelling – and is offered with the hope of furthering a healthy and constructive discussion of this issue.

Asalamualaikum wrt wb,

All praise be to Allah.

The summary is that in order to celebrate the start of Ramadan or Eid the moon should be physically sighted, because the Prophet pbuh said, "Fast when (the crescent) is seen, and stop fasting when it is seen."  The hadith of the Prophet alayhi as salaam is Law, and it should be applied, and not ignored or interpreted metaphorically.  This is the understanding followed for 14 centuries, and it is followed by the rest of the world.

I am heartened to see scholars such as Dr. Maghraoui and Sh. Hamza Yusuf defending the hadith of the Prophet alayhi as salaam.  When we follow the Sunnah, we will be successful. 

The differences between the scholars is a mercy, and few understand this secret.

And Allah knows best.

Be merciful to those on earth, and the One in the Heavens will be merciful to you.
